The appeal had been filed by the husband in Bombay High Court against the order of Family court, challenging the order to give ₹15,000 per month to his wife for her smooth living.

The Bombay high court rejected the appeal and said that since the wife is earning more or meagre amount, the duty of the husband cannot be denied from giving money for his wife smooth living. In this case, the wife was earning meagre amount of money whereas the husband is earning huge income. The wife is living currently with her brother for her living whereas it is the duty of the husband to provide smooth lifestyle to his wife after marriage and not that of brother.

The Bombay High court ordered that even if the wife is earning, it does not mean that the husband’s duty has been eliminated. Whether the wife is earning or not, it is duty of the husband to give the money from his income to the wife for her lifestyle.
